📋 Terms and Conditions

⚠️ These Terms and Conditions (“Terms”) govern your access to and use of the MOM Finance money transfer platform at
https://momfinance.to.
By using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms.

1. Acceptance of Terms

By accessing and using the Platform, you agree to be bound by these Terms and our Privacy Policy, Cookie Policy, and Return & Refund Policy. If you do not agree to these Terms, you may not use the Platform.

2. Services Provided

MOM Finance provides international money transfer services between Tonga (TOP) and Australia (AUD) in both directions. We operate as:

🇹🇴 Tonga Licence

Licensed as a Type A Foreign Exchange Dealer by the National Reserve Bank of Tonga (NRBT).

🇦🇺 Australian Licence

Operating in partnership with JATF & T Pty Ltd (AUSTRAC Registration No. IND100613618-002), a registered Independent Remittance Dealer in Australia.

3. Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Have legal capacity to enter into binding contracts
  • Provide accurate, current, and complete identification information
  • Not be located in a sanctioned jurisdiction
  • Not be a politically exposed person (PEP) without prior approval

4. Account Registration

4.1 Account Creation

You must create an account to use our services. During registration, you agree to provide true, accurate, current, and complete information and maintain the accuracy of this information at all times.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorised use. MOM Finance is not liable for any loss resulting from unauthorised use of your account.

5. Transaction Limits and Fees

5.1 Transaction Limits

  • Single Transaction Limit: TOP / AUD 10,000
  • Monthly Limit per Customer: TOP / AUD 50,000
  • Higher limits may be requested and require enhanced due diligence documentation

5.2 Fees and Exchange Rates

  • Transaction Fees: ZERO — Free to send
  • Exchange Rate Margin: Applied to the mid-market rate (displayed transparently before confirmation)
  • Rates updated daily from OANDA, Xe.com, Reuters
  • All exact amounts clearly displayed before you confirm any transaction

6. Prohibited Uses

⛔ You may NOT use the Platform to:
  • Engage in money laundering or terrorism financing
  • Make or receive payments connected to illegal activities
  • Provide false or misleading information
  • Attempt to circumvent security measures or transaction limits
  • Transfer funds to or from sanctioned individuals, entities, or governments
  • Use the service for commercial business purposes (unless expressly authorised)

Violation of these prohibitions may result in immediate account suspension, reporting to AUSTRAC/NRBT, and potential legal action.

7. Verification and Compliance

We are legally required to verify customer identity and screen transactions for money laundering and terrorism financing. You agree to provide all requested documents and information. We reserve the right to suspend service, cancel transactions, or close accounts without prior notice if compliance requirements are not met.

8. Transaction Processing

  • Processing Time: Typically within 24 hours of confirmation
  • Delays may occur due to compliance screening, bank processing times, or technical issues
  • Transactions are irrevocable once funds have been delivered to the recipient
  • MOM Finance will notify you of any significant delays via email

9. Cancellations and Refunds

You may cancel a transaction before it is processed. Once a transaction is completed and funds delivered, cancellations are not possible except where MOM Finance is at fault. All refunds are governed by our Return & Refund Policy, which includes a 5% processing fee for customer-initiated refunds and a full refund for MOM Finance errors.

10. Liability Limitation

MOM Finance’s total liability for any claim arising from use of the Platform shall not exceed the amount of fees paid for the specific transaction in question. We are not liable for indirect, consequential, special, or incidental damages. We are not responsible for losses arising from exchange rate fluctuations, delays caused by recipient banks, or events beyond our reasonable control.

11. Indemnification

You agree to indemnify and hold harmless MOM Finance, its directors, officers, and agents from any claims, damages, or expenses arising from your use of the Platform, breach of these Terms, or violation of any third-party rights.

12. Termination

We may suspend or terminate your account at any time without notice for breach of these Terms, suspicious activity, or regulatory requirements. You may close your account at any time by contacting us. Termination does not affect any obligations or liabilities incurred prior to termination.

13. Governing Law

These Terms are governed by the laws of the Kingdom of Tonga. Any dispute shall be resolved in the courts of Tonga, unless otherwise required by applicable Australian law for transactions processed through JATF & T Pty Ltd in Australia.
